What If Employer Refuses to Pay Gratuity?

  1. Send written notice to employer (registered post)
  2. File complaint with Controlling Authority (Labour Commissioner) in your district
  3. Authority issues payment order within 60 days
  4. Delayed payment: employer pays 10% p.a. interest on gratuity amount
  5. Willful refusal: imprisonment up to 2 years + fine

Do I lose gratuity if I resign before 5 years? +
Yes, no gratuity if you resign before completing 5 years with same employer. Each employer counted separately — 3 years at Company A + 3 years at Company B = no gratuity from either (unless both are same group company). Death or permanent disability: gratuity paid even before 5 years.
Is gratuity part of CTC? +
Many companies include gratuity provision in CTC: Gratuity provision = Basic × 4.81% (15/26 × 1/12). If your CTC shows gratuity ₹25,000/year, your annual basic = approximately ₹5,20,000. This is a "notional" cost to employer — you actually receive it only after 5 years of service upon leaving.
